James Howard appeared in Jasper County Circuit Court before the Honorable Judge Harvey with his attorney, Richard Runde, for sentencing in the (08-CF-52) case of Aggravated Criminal Sexual Abuse, dating from March/April in 2006.

Howard plead guilty to Aggravated Criminal Sexual Abuse on August 18, 2009.

At Howard's sentencing his wife, aunt; and employer were his character witnesses stating that they didn't believe the defendant did the crime. They also stated they felt he was a law abiding citizen and reliable. His employer Marty Moran stated that the defendant expressed remorse.

The victim also made a statement.

Runde stated that the offense is a class II felony and is probational. He stated the defendant is willing to pay for the victim's counseling and restitution.

States Attorney Kevin Parker commented on the defendant's previous attitudes in regards to his psychiatric testing.

Then the defendant had the opportunity to speak. Howard told the victim that he was sorry and he asked for forgiveness from the victim and her family, and also from his family.

After reviewing notes, Judge Harvey pronounced his sentence of 3 years in the D.O.C., an order for reimbursement for counseling for the victim now and in the future and the defendant has to pay for D.N.A. testing.

Runde stated he would file a motion to reconsider.

Howard was allowed approximately one hour at the courthouse, under supervision, to say good bye to his family, before being taken to the Jasper County Jail where he remained until transfer to the D.O.C.
